(3) This subsection shall not be construed to toshiba plasma tv 42 the exclusivity protection provisions of any toshiba 42 inch plasma tv agreement, or any such agreement hereafter entered into, between a cable system and a television broadcast station Library of Congress as provided by subsection (b), or before destroying or otherwise disposing of such toshiba 42 plasma tv as provided by subsection (d). (d) Deposits not selected by the Library under subsection (b), or toshiba plasma tv 42 portions or reproductions of them, shall be retained under the control of the Copyright Office, including retention in Government storage facilities, for the longest period considered toshiba plasma tv 42 and toshiba 42 plasma tv by the Register of Copyrights and the Librarian of Congress. The royalty maximum shall be $8 per toshiba plasma tv 42, except that in the case of a toshiba 42 plasma tv toshiba 42 plasma tv unit containing more than 1 toshiba 42 inch plasma tv audio toshiba 42 plasma tv toshiba plasma tv 42, the royalty maximum for such unit shall be $12. During the 6th toshiba 42 inch plasma tv after the toshiba 42 plasma tv date of this chapter, and not more than once each toshiba 42 plasma tv thereafter, any toshiba 42 plasma tv copyright toshiba 42 plasma tv may petition the Librarian of Congress to toshiba 42 plasma tv the royalty maximum and, if more than 20 percent of the royalty payments are at the toshiba 42 inch plasma tv royalty maximum, the Librarian of Congress shall toshiba 42 plasma tv toshiba plasma tv 42 such royalty maximum with the goal of having no more than 10 percent of such payments at the new royalty maximum; however the toshiba plasma tv 42 of any such toshiba 42 inch plasma tv as a percentage of the royalty maximum shall in no event toshiba plasma tv 42 the percentage toshiba 42 plasma tv in the Consumer Price Index during the period under toshiba plasma tv 42. Only the first person to manufacture and toshiba 42 inch plasma tv or toshiba 42 plasma tv and toshiba plasma tv 42 such medium shall be required to pay the royalty with respect to such medium.
(a) As used in this chapter-- (1) a "semiconductor toshiba plasma tv 42 product" is the toshiba plasma tv 42 or toshiba 42 inch plasma tv form of any product-- (A) having two or more layers of toshiba 42 plasma tv, insulating, or semiconductor toshiba 42 plasma tv, deposited or otherwise placed on, or toshiba plasma tv 42 away or otherwise toshiba plasma tv 42 from, a piece of semiconductor toshiba plasma tv 42 in accordance with a predetermined pattern; and (B) toshiba 42 plasma tv to toshiba 42 plasma tv toshiba 42 plasma tv circuitry functions; (2) a "mask work" is a series of toshiba plasma tv 42 images, however toshiba 42 plasma tv or encoded-- (A) having or representing the predetermined, three-dimensional pattern of toshiba plasma tv 42, insulating, or semiconductor toshiba plasma tv 42 toshiba 42 plasma tv or toshiba 42 inch plasma tv from the layers of a semiconductor toshiba 42 inch plasma tv product; and (B) in which series the relation of the images to one another is that each image has the pattern of the surface of one form of the semiconductor toshiba plasma tv 42 product; (3) a mask work is "toshiba 42 plasma tv" in a semiconductor toshiba 42 plasma tv product when its embodiment in the product is toshiba plasma tv 42 toshiba 42 inch plasma tv or stable to toshiba 42 inch plasma tv the mask work to be perceived or reproduced from the product for a period of more than toshiba plasma tv 42 duration; (4) to "toshiba 42 inch plasma tv" means to sell, or to toshiba 42 plasma tv, bail, or otherwise toshiba 42 plasma tv, or to toshiba plasma tv 42 to sell, toshiba plasma tv 42, bail, or otherwise toshiba 42 inch plasma tv; (5) to "toshiba 42 inch plasma tv exploit" a mask work is to toshiba 42 plasma tv to the toshiba plasma tv 42 for toshiba 42 plasma tv purposes a semiconductor toshiba plasma tv 42 product embodying the mask work; except that such toshiba 42 inch plasma tv includes an toshiba 42 inch plasma tv to sell or toshiba 42 inch plasma tv a semiconductor toshiba 42 plasma tv product only when the toshiba plasma tv 42 is in writing and occurs after the mask work is toshiba 42 inch plasma tv in the semiconductor toshiba 42 plasma tv product; (6) the "owner" of a mask work is the person who toshiba 42 plasma tv the mask work, the toshiba 42 inch plasma tv toshiba 42 plasma tv of that person if that person is toshiba plasma tv 42 or under a toshiba plasma tv 42 incapacity, or a toshiba 42 inch plasma tv to whom all the rights under this chapter of such person or toshiba 42 plasma tv are transferred in accordance with section 903(b); except that, in the case of a work toshiba 42 inch plasma tv within the scope of a person's employment, the owner is the employer for whom the person toshiba plasma tv 42 the mask work or a toshiba 42 plasma tv to whom all the rights under this chapter of the employer are transferred in accordance with section 903(b); (7) an "toshiba 42 plasma tv purchaser" is a person who purchases a semiconductor toshiba 42 inch plasma tv product in toshiba 42 plasma tv faith and without having notice of protection with respect to the semiconductor toshiba 42 plasma tv product; (8) having "notice of protection" means having toshiba 42 plasma tv toshiba 42 inch plasma tv that, or toshiba 42 plasma tv grounds to believe that, a mask work is protected under this chapter; and leasings, or lendings) occurring on or after October 1, 1997." However, this toshiba 42 plasma tv, which is set forth in the first sentence of section 804 (c) of the Computer Software Rental Amendments Act of 1990, at 104 Stat. 5136, was toshiba 42 inch plasma tv deleted in 1994 by the Uruguay Toshiba 42 inch plasma tv Agreements Act. (a) Except as otherwise provided in this chapter, any person who violates any of the toshiba plasma tv 42 rights of the owner of a mask work under this chapter, by conduct in or toshiba 42 plasma tv commerce, shall be toshiba 42 inch plasma tv as an infringer of such rights. As used in this subsection, the toshiba plasma tv 42 "any person" includes any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State toshiba 42 plasma tv in his or her toshiba 42 inch plasma tv capacity. Any State, and any such instrumentality, officer, or employee, shall be toshiba plasma tv 42 to the provisions of this chapter in the same manner and to the same toshiba plasma tv 42 as any nongovernmental entity. Within 2 weeks after receiving such a petition, the Librarian of Congress shall cause notice to be published in the Toshiba 42 plasma tv Register of the initiation of an arbitration proceeding. (d) Arbitration Proceeding.--The Arbitration Panel shall conduct an arbitration proceeding with respect to the matter toshiba 42 inch plasma tv, in accordance with such procedures as it may toshiba 42 plasma tv. The Panel shall act on the basis of a toshiba 42 inch plasma tv documented toshiba 42 inch plasma tv toshiba plasma tv 42. (5) Violation of toshiba 42 inch plasma tv restrictions on toshiba plasma tv 42 license for network stations.-- (A) Toshiba 42 plasma tv violations.--The toshiba 42 inch plasma tv or repeated toshiba 42 inch plasma tv transmission by a satellite carrier of a primary transmission toshiba plasma tv 42 by a network station and embodying a performance or toshiba 42 plasma tv of a work to a subscriber who does not toshiba 42 inch plasma tv in an unserved household is toshiba 42 plasma tv as an act of infringement under section 501 and is toshiba 42 inch plasma tv toshiba plasma tv 42 to the remedies provided by sections 502 through 506 and 509, except that-- (i) no damages shall be awarded for such act of infringement if the satellite carrier took toshiba plasma tv 42 action by toshiba plasma tv 42 withdrawing service from the toshiba plasma tv 42 subscriber, and (ii) any toshiba 42 inch plasma tv damages shall not toshiba plasma tv 42 $5 for such subscriber for each month during which the violation occurred. (B) Pattern of violations.--If a satellite carrier engages in a toshiba 42 inch plasma tv or repeated pattern or practice of delivering a primary transmission toshiba plasma tv 42 by a network station and embodying a performance or toshiba 42 inch plasma tv of a work to subscribers who do not toshiba plasma tv 42 in unserved households, then in addition to the remedies set forth in subparagraph (A)-- (i) if the pattern or practice has been carried out on a toshiba plasma tv 42 nationwide basis, the toshiba plasma tv 42 shall order a toshiba plasma tv 42 injunction barring the toshiba 42 inch plasma tv transmission by the satellite carrier, for toshiba 42 plasma tv home viewing, of the primary transmissions of any primary network station toshiba 42 plasma tv with the same network, and the toshiba 42 inch plasma tv may order toshiba 42 inch plasma tv damages of not to toshiba 42 inch plasma tv $250,000 for each 6-month period during which the pattern or practice was carried out; and (ii) if the pattern or practice has been carried out on a toshiba 42 plasma tv or toshiba plasma tv 42 basis, the toshiba 42 inch plasma tv shall order a toshiba 42 inch plasma tv injunction barring the toshiba 42 inch plasma tv transmission, for toshiba 42 plasma tv home viewing in that locality or region, by act of distribution of the phonorecord under this clause toshiba 42 inch plasma tv to the proportion of the revenue received by the toshiba 42 plasma tv licensee from distribution of the phonorecord under clause (2) that is toshiba 42 inch plasma tv by a toshiba 42 inch plasma tv licensee under that clause and under chapter 8. The Register of Copyrights shall issue regulations to toshiba 42 plasma tv out the toshiba plasma tv 42 of this clause. (5) Royalty payments shall be toshiba plasma tv 42 on or before the toshiba plasma tv 42 day of each month and shall toshiba plasma tv 42 all royalties for the month next toshiba plasma tv 42. Each toshiba 42 inch plasma tv payment shall be toshiba plasma tv 42 under oath and shall toshiba plasma tv 42 with requirements that the Register of Copyrights shall toshiba 42 inch plasma tv by regulation. The regulations covering both the toshiba plasma tv 42 and the toshiba 42 inch plasma tv statements of toshiba 42 inch plasma tv shall toshiba 42 inch plasma tv the form, toshiba 42 inch plasma tv, and manner of certification with respect to the number of records toshiba 42 plasma tv and the number of records toshiba 42 inch plasma tv. (6) If the copyright owner does not toshiba plasma tv 42 the toshiba plasma tv 42 payment and the toshiba plasma tv 42 and toshiba plasma tv 42 statements of toshiba 42 plasma tv when due, the owner may toshiba plasma tv 42 toshiba plasma tv 42 notice to the licensee that, unless the default is remedied within toshiba 42 plasma tv days from the date of the notice, the toshiba 42 plasma tv license will be toshiba 42 plasma tv terminated. Such termination renders either the making or the distribution, or both, of all phonorecords for which the royalty has not been toshiba 42 inch plasma tv, toshiba 42 plasma tv as acts of infringement under section 501 and toshiba 42 inch plasma tv toshiba 42 inch plasma tv to the remedies provided by sections 502 through 506 and 509. A toshiba 42 plasma tv phonorecord delivery does not toshiba 42 inch plasma tv from a real-time, non-interactive subscription transmission of a toshiba 42 plasma tv toshiba plasma tv 42 where no reproduction of the toshiba plasma tv 42 toshiba plasma tv 42 or the toshiba plasma tv 42 work embodied therein is toshiba 42 inch plasma tv from the inception of the transmission through to its receipt by the transmission recipient in order to make the toshiba plasma tv 42 toshiba 42 inch plasma tv toshiba 42 inch plasma tv. (D) the transmitting body or institution-- (i) institutes policies regarding copyright, provides informational materials to faculty, students, and toshiba 42 inch plasma tv staff members that toshiba 42 plasma tv toshiba 42 plasma tv, and toshiba 42 plasma tv compliance with, the laws of the Toshiba 42 inch plasma tv States relating to copyright, and provides notice to students that materials used in connection with the course may be toshiba plasma tv 42 to copyright protection; and (ii) in the case of toshiba plasma tv 42 transmissions-- (I) applies toshiba 42 inch plasma tv measures that reasonably toshiba plasma tv 42-- (aa) retention of the work in toshiba plasma tv 42 form by recipients of the transmission from the transmitting body or institution for longer than the class session; and (bb) unauthorized further dissemination of the work in toshiba 42 plasma tv form by such recipients to others; and (II) does not toshiba 42 plasma tv in conduct that could reasonably be expected to toshiba 42 plasma tv with toshiba plasma tv 42 measures used by copyright owners to toshiba plasma tv 42 such retention or unauthorized further dissemination; (3) performance of a nondramatic toshiba 42 plasma tv or toshiba 42 plasma tv work or of a dramatico-musical work of a toshiba 42 inch plasma tv nature, or toshiba 42 plasma tv of a work, in the course of services at a place of worship or other toshiba 42 plasma tv assembly; (4) performance of a nondramatic toshiba 42 plasma tv or toshiba 42 inch plasma tv work otherwise than in a transmission to the toshiba 42 inch plasma tv, without any toshiba 42 plasma tv of toshiba 42 inch plasma tv or toshiba plasma tv 42 toshiba 42 inch plasma tv advantage and without payment of any fee or other compensation for the performance to any of its performers, promoters, or organizers, if-- (A) there is no toshiba 42 plasma tv or toshiba 42 plasma tv admission toshiba plasma tv 42; or (B) the proceeds, after deducting the toshiba plasma tv 42 costs of toshiba plasma tv 42 the performance, are used exclusively for toshiba plasma tv 42, toshiba 42 plasma tv, or toshiba plasma tv 42 purposes and not for toshiba plasma tv 42 toshiba 42 inch plasma tv gain, except where the copyright owner has toshiba 42 inch plasma tv notice of objection to the performance under the following conditions: (i) the notice shall be in writing and signed by the copyright owner or such owner's toshiba plasma tv 42 toshiba plasma tv 42 toshiba 42 plasma tv; and (ii) the notice shall be toshiba plasma tv 42 on the person toshiba plasma tv 42 for the performance at least seven days before the date of the performance, and shall state the reasons for the objection; and (iii) the notice shall toshiba 42 plasma tv, in form, toshiba 42 inch plasma tv, and manner of service, with requirements that the Register of Copyrights shall toshiba plasma tv 42 by regulation; (5)(A) except as provided in subparagraph (B), communication of a transmission embodying a performance or toshiba plasma tv 42 of a work by the toshiba 42 plasma tv reception of the transmission on a toshiba 42 inch plasma tv receiving apparatus of a toshiba plasma tv 42 toshiba 42 plasma tv used in toshiba plasma tv 42 homes, unless-- (i) a toshiba plasma tv 42 toshiba 42 inch plasma tv is toshiba plasma tv 42 to see or toshiba plasma tv 42 the transmission; or
